This Site is owned and operated by Kim Anderson Pty Limited (ABN 19 074 659 635) ("we", "us", "our"). We sell paperback copies of the novel The Prize directly through our online book shop.
These Terms apply to all visitors, subscribers and customers of the Site ("you", "your"). They should be read together with our Privacy Policy, Cookies Policy, Shipping Policy and Refunds and Returns Policy, each of which forms part of these Terms.

1. Your rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right, warranty or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted or modified. Where any provision of these Terms would have that effect, that provision does not apply to you to that extent.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be of acceptable quality and will match their description. See our Refunds and Returns Policy for how to make a claim.
2. Acceptance of these Terms
By accessing or using this Site, or by placing an order, you accept these Terms. In doing so you confirm that you have the legal capacity to enter into a binding contract and that you will comply with these Terms.
Where you click "Agree", "Accept", "Buy" or a similar option, or tick a box confirming acceptance, that action is legally binding and has the same effect as your handwritten signature.
If you are under 18, you may only place an order with the involvement of a parent or guardian, who accepts these Terms on your behalf.
If anything in these Terms is unclear, please contact us before completing a purchase.
3. Changes to these Terms
We may update these Terms from time to time. Any change takes effect from the date the revised version is published on the Site, identified by the Effective Date at the top.
Changes do not apply retrospectively. The Terms in force at the time you place an order govern that order. Your continued use of the Site after a change is published constitutes acceptance of the revised Terms for future orders.
We keep dated copies of previous versions and will provide a copy on request.
4. Orders
Our product listings are an invitation for you to place an order. They are not an offer.
When you submit an order you make an offer to purchase. We accept that offer, and a contract is formed between us, only when we send you a dispatch confirmation email. Our order acknowledgement email confirms that we have received your order; it is not acceptance of it.
We may decline or cancel an order before dispatch, and will refund you in full, where:
the book is out of stock or no longer available;
there has been an obvious error in the price or product description;
we are unable to verify your payment or delivery details; or
we reasonably suspect fraud or other unlawful activity.
We will tell you promptly if we decline or cancel your order and explain why.
You may cancel your order at any time before dispatch by emailing contact@kimeanderson.com. We will refund you in full.
Limited stock and the condition of our copies
The copies we sell are from the publisher's remaindered stock of the paperback edition, which we purchased outright. Our stock is limited and we will not be able to restock once it is sold.
Because these copies have previously been through the retail supply chain, some may carry a publisher's remainder mark — usually a felt-tip stroke or dot on the outside page edges near the spine — and some may show minor shelf wear to the cover or edges. The text is complete and unread. We describe the condition of our copies on the product page, and where a copy has a remainder mark we say so.
This does not affect your rights under the Australian Consumer Law. If a copy arrives in worse condition than we have described, that is a problem with the goods and our Refunds and Returns Policy applies.
Quantities and resale
Our book shop is intended for personal purchases and gifts, and because our stock is limited we may decline or limit unusually large orders. If you are a bookseller, library, school or event organiser and would like to buy in quantity, please contact us at contact@kimeanderson.com — we would be glad to hear from you.
Once you own a copy of the book, it is yours: you may of course lend it, give it away or resell that copy.
5. Prices and payment
All prices are in Australian dollars.
Prices displayed are inclusive of Australian Goods and Services Tax (GST). A tax invoice will be issued with your order.
The displayed price includes delivery within Australia. The book costs $35, including GST and standard delivery within Australia. Choose Express Post at checkout for an additional $4.99, bringing the total to $39.99. Delivery outside Australia is quoted separately by email. See our Shipping Policy.
We may change prices at any time, but the price that applies to your order is the price displayed at the time you place it.
We accept payment by credit card, debit card and Apple Pay. We do not accept PayPal. All payments are processed securely by Stripe and are subject to Stripe's terms. We do not receive or store your full card details.
Where you pay by card, you confirm that you are authorised to use it. If your payment is declined or reversed, we may cancel your order and will notify you.
Discount codes
Where we offer a discount code, only one code may be used per order, and codes are subject to any conditions stated when the code is issued, including expiry dates and eligibility. Codes cannot be used in conjunction with another offer unless we say otherwise, have no cash value, and cannot be applied to an order already placed.
6. Delivery, risk and title
Delivery timeframes, postage costs, tracking and lost or damaged parcels are dealt with in our Shipping Policy, which forms part of these Terms.
We deliver within Australia as standard, and to selected overseas destinations by prior arrangement (see our Shipping Policy). Risk in the book passes to you on delivery. Title passes to you when we have received payment in full.
Delivery estimates are estimates only and are not guaranteed. Where a delay is likely, we will contact you and you may cancel for a full refund.
7. Refunds and returns
Your rights to a repair, replacement or refund are set out in our Refunds and Returns Policy, which forms part of these Terms and does not limit your rights under the Australian Consumer Law.
8. Intellectual property
The book
Copyright in the text of The Prize is held by Kim Anderson Pty Limited. The novel is published in Australia and New Zealand under an exclusive licence by Pantera Press Pty Limited (Hardie Grant). All rights outside Australia and New Zealand — including United States, United Kingdom, foreign language, film, television and dramatic rights — are retained by Kim Anderson Pty Limited. Kim E Anderson's moral rights as author are asserted.
Copyright in the published edition's presentation — including the cover design and artwork, typography, layout and blurb — is owned by Pantera Press Pty Limited and is reproduced on this Site with permission.
Purchasing a copy of The Prize gives you ownership of that physical copy. It does not give you any rights in the text, the cover or the published edition.
The Site
The Site and its content — including text, blog posts, images, photographs, design and layout ("Content") — is owned by us, is in the public domain, or is used with the permission of the rights holder, who retains ownership of it. Historical photographs reproduced on the Site are out of copyright in Australia or are used with permission, and are credited where a credit has been requested. Your use of the Site does not transfer any rights in the Content to you.
What you must not do
Without our prior written consent, you must not:
reproduce, scan, digitise, publish, transmit, adapt or create derivative works from the Content;
reproduce the text of the book in whole or in substantial part, other than as permitted by the Copyright Act 1968 (Cth) — for example, fair dealing for criticism, review, parody or research; or
use our name, the book title or the cover artwork in advertising, promotion or merchandise.
Nothing here prevents you from quoting briefly from the book in a review, or from discussing it.

9. Reviews, comments and content you submit
We welcome reviews and feedback. If you submit a review, comment or other content to the Site or our social media channels, you:
confirm you are the author and owner of that content, or have permission to submit it;
grant us a non-exclusive, royalty-free licence to reproduce and share it on the Site, in marketing material and on our social media channels, with attribution to the name you provide;
consent, to the extent permitted by the Copyright Act 1968 (Cth), to us using the content without attribution of authorship and to us making changes for length or clarity; and
confirm the content does not infringe anyone's rights and is not unlawful, defamatory, abusive or obscene.
We may decline to publish, or may remove, content that is unlawful, defamatory, abusive or obscene, discloses personal information, or is unrelated to the book.
Reviews and quoted endorsements on the Site are the opinions of the people who wrote them and do not represent our views.
10. Newsletter and marketing
If you subscribe to our newsletter, you consent to receiving emails from us about the book, events and writing. We comply with the Spam Act 2003 (Cth). Every email contains an unsubscribe link, and you can unsubscribe at any time or by emailing contact@kimeanderson.com. We do not sell your details. See our Privacy Policy.
11. Privacy and cookies
Our Privacy Policy explains how we collect, use, hold and disclose your personal information, and our Cookies Policy explains our use of cookies and similar technologies. Both form part of these Terms.
12. Permitted use of the Site
You must not:
use the Site for any unlawful purpose or in breach of any law;
interfere with, damage, deface or attempt to gain unauthorised access to the Site or its underlying systems;
introduce any virus or malicious code, or corrupt data;
use any automated means to collect content or data from the Site, or to place orders;
send unsolicited advertising or promotional material through the Site or our contact form; or
infringe the rights of any other person.
13. Information on the Site
Blog posts, historical material, author notes and other editorial content on the Site are provided for general interest and information only. While we take care with research, we do not warrant that this content is complete or free from error, and it is not professional advice.
The Prize is a work of fiction inspired by historical events and real people. Nothing in the novel or on the Site should be taken as a statement of historical fact about any identified person.
14. Links to other websites
The Site contains links to other websites, including booksellers and media coverage. We do not control those sites and are not responsible for their content, availability, terms or privacy practices. Links are provided for convenience and are not an endorsement.
15. The Site itself
We aim to keep the Site available and accurate, but we provide it on an "as is" basis. To the extent permitted by law, and subject to clause 1, we do not warrant that the Site will be uninterrupted, error-free, secure or free of harmful code, or that any defect will be corrected. We may change, suspend or withdraw the Site or any part of it at any time.
This clause applies to the Site only. It does not limit the consumer guarantees that apply to the books we sell.
16. Limitation of liability
Subject to clause 1, and to the extent permitted by law:
we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or opportunity, arising from your use of the Site or from any product you purchase; and
our total liability to you in connection with any order is limited to the amount you paid for that order.
Where the Australian Consumer Law applies and permits us to do so, our liability for a failure to comply with a consumer guarantee is limited to replacing the book, supplying an equivalent book, or refunding the amount you paid.
Nothing in this clause limits our liability for fraud, or for any liability that cannot be limited by law.
17. Indemnity
You agree to compensate us for any loss, liability or reasonable cost we incur as a direct result of:
your breach of these Terms;
your unlawful or fraudulent conduct in connection with the Site; or
a third-party claim arising from content you submit to us.
This obligation does not apply to the extent the loss was caused or contributed to by us, and does not extend to loss we could reasonably have avoided.
18. Suspension and termination
We may suspend or end your access to the Site, or close any account you hold with us, if you breach these Terms or any applicable law.
If we do so, we will still fulfil any order already accepted, or refund you in full if we cannot.
Clauses 8, 9, 16, 17 and 20 survive termination.
19. Complaints and disputes
If you have a concern or complaint, please contact us first at contact@kimeanderson.com. We will acknowledge your message within 2 business days and try to resolve the matter promptly and fairly.
If we cannot resolve it, you may seek assistance from NSW Fair Trading or the Australian Competition and Consumer Commission. Nothing in these Terms prevents you from exercising any right you have at law.
20. General
Governing law. These Terms, and any contract between us, are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
Entire agreement. These Terms, together with the Privacy Policy, Cookies Policy, Shipping Policy and Refunds and Returns Policy, form the entire agreement between us in relation to your use of the Site and your purchase of our products, and replace any earlier version.
Severability. If any provision of these Terms is found to be unenforceable, it is to be read down to the minimum extent necessary, or severed, and the remaining provisions continue to apply.
No waiver. If we do not enforce a right under these Terms, that is not a waiver of that right.
Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor of our business, provided your rights are not adversely affected.
Force majeure. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including postal disruption, natural disaster or failure of third-party services. Where a delay is material, you may cancel for a full refund.
